Brightline Sing-Along Train & Concert Tickets to The Big Concert Sweepstakes Official Rules

These Official Rules govern the Brightline Sing-Along Train & Concert Tickets to The Big Concert Sweepstakes (“Sweepstakes”) sponsored by Brightline Trains Florida, LLC (“Sponsor”) and are binding on everyone who participates in the Sweepstakes.

PRIZE:

One Sweepstakes winner shall win four (4) SMART round-trip sing-along Brightline train tickets to The Big Concert and two (2) Miami Eras Tour Tickets (Section 332, Row 28, Seats 21-22) on Sunday, October 20th at Hard Rock Stadium located at 347 Don Shula Dr, Miami Gardens, FL 33056 (the “Prize”). A total of one (1) individual winner will be selected. The approximate retail value (“ARV”) of this Prize is $8,983.13 USD.

ELIGIBILITY:

The Sweepstakes is open to legal residents of the United States of America (where not prohibited by law) and who are eighteen (18) years of age or older at the time of entry. Employees and officers of Brightline Trains Florida LLC, or any of its affiliates and any immediate family members (spouses, parents, children, and siblings and their spouses) or members of the same households (whether related or not) of such individuals are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of each entrant. Each individual meeting the Eligibility requirements during the Submission Period will automatically qualify for the Sweepstakes.

HOW TO ENTER:

Each individual meeting the Eligibility Requirements during the Submission Period will automatically qualify for the Sweepstakes. All entrants must follow @GoBrightline on Instagram and sign Brightline’s safety pledge at www.gobrightline.com/offers/big-sweeps. Only one entry per email and Instagram account.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER THE SWEEPSTAKES.

SWEEPTSTAKES ENTRY SUBMISSION PERIOD:

The period to submit sweepstakes entries begins on August 13, 2024, at 12:01 AM EST and ends on September 20, 2024, at 11:59 PM EST (the “Submission Period”). Entries must be received during the Submission Period to be eligible.

SELECTION OF SWEEPSTAKES WINNERS:

One (1) winning entry of the Sweepstakes will be selected from among all eligible entries via a random drawing to be conducted on September 23, 2024. Odds of winning the Sweepstakes prize depend on the total number of eligible Entries received.

NOTIFICATION:

The winner will be notified via email utilizing the email address provided upon entry. Each entrant is responsible for monitoring his/her email account for prize notification. A winner must respond within three business days following receipt of prize notification (the “Prize Claim Period”) in order to claim his/her prize(s). In order to claim a prize, a winner must have or create a Brightline account, provide Sponsor an email address associated with the Brightline account, and proof of eligibility. The Brightline account must stay subscribed to Brightline’s email database for the duration of the Prize Claim Period for the winner to claim the Sweepstakes prize. A winner’s failure to create a Brightline account, take the Brightline safety pledge and to provide to Sponsor the valid email address associated with such account within the Prize Claim Period shall be deemed such winner’s forfeit of the prize(s) and an alternate winner will be selected. The winner shall notify Sponsor at the time the winner claims his/her prize of the requested train times to book the Brightline train tickets for travel on October 20, 2024. Booking of Brightline train tickets is subject to availability.

To obtain a copy of the Sweepstakes winners' names, the request should be emailed to the Sponsor: Brightline Trains Florida LLC, marketing@gobrightline.com. Subject Line: Attn: Legal Department – Brightline Sing-Along Train Sweepstakes. Requests must be received no later than December 31, 2024.

GENERAL RULES:

All entrants acknowledge that the results of the Sweepstakes, as determined by the Sponsor and its agents in their sole discretion, shall be final in all respects. All entries must be complete to be valid, which includes providing a name, address, and email address. Sponsor may require each winner to provide an affidavit of eligibility, a liability release, a publicity release (where legal), and/or an IRS W-9 form.

The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by applicable law.

Except as determined by Sponsor in its sole discretion, no substitution of any prize is offered, no transfer of any prize to a third party is permitted, and no prize may be redeemed for cash value. Any difference between the stated approximate value of any prize and actual value of such prize will not be awarded. Concert tickets are non-transferable and cannot be resold. Prize and its components may not be used in conjunction with any other promotion or offer, separated, sold, exchanged or redeemed for cash, traded, transferred, substituted, assigned, or rescheduled to dates other than as set forth above, except in Sponsor’s sole and absolute discretion. Use of Brightline train tickets is subject to Brightline’s Terms of Services which can be found at https://www.gobrightline.com/terms-of-service.

This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Taylor Swift, Taylor Nation, LLC, TAS Rights Management, LLC, South Florida Stadium LLC d/b/a Hard Rock Stadium or any affiliated entities. The prizes offered in this Sweepstakes are independently provided by Brightline Trains Florida, LLC. Any references to Taylor Swift, her concerts, or her related entities and/or Hard Rock Stadium are for descriptive purposes only.

ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER

All other costs and expenses which are not specifically mentioned in these Official Rules and which may be associated with the award, acceptance, receipt, and use of all or any portions of the awarded prize are solely the responsibility of the respective prize winner. Any portion of a prize not accepted by the winner will be forfeited. In no event will Sponsor be liable to award more than the number of prizes stated in these Official Rules. Odds of winning depend on the number of eligible entries received.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of all entrants and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules. Any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes or any prize awarded shall be resolved exclusively in the appropriate federal or state court located in Miami-Dade County, Florida and each entrant hereby consents and submits to the personal jurisdiction of such courts.

BY ENTERING THIS SWEEPSTAKES, ALL SWEEPSTAKES ENTRANTS AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right, in its sole discretion, to disqualify any individual (i) suspected of tampering with the entry process or the operation of the sweepstakes, (ii) acting in a manner deemed by Sponsor to be in violation of these Official Rules, or (iii) acting in a manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten, or harass any other person. In the event Sponsor is prevented from continuing with the Sweepstakes by any event beyond its control, including, but not limited to, fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, or other cause not

reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Sweepstakes or Prize.

ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A POTENTIAL VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor assumes no responsibility or liability for (i) any incorrect or inaccurate registration or entry information, or for any faulty, failed, garbled, or jumbled electronic data transmissions; (ii) any unauthorized access to or theft, destruction, or alteration of any submission at any point in the operation of the sweepstakes; (iii) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilized in any aspect of the sweepstakes; (iv) inaccessibility or unavailability of the Internet; or (v) any bodily injury or property damage suffered by an entrant or any other person which may be related to or resulting from any attempt to participate in the sweepstakes. If for any reason, the Sweepstakes is not capable of running as planned for any reason, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, then Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the sweepstakes in whole or in part.

All Sweepstakes entrants, as a condition of entry into the Sweepstakes, agree that Sponsor, anyone acting on behalf of Sponsor, or any of their respective licensees, successors, and assigns will have the right, where permitted by law, without any further notice, review, or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, an entrant’s entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

All entrants, as a condition of entry into the Sweepstakes, agree to release Sponsor from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with (i) accessing the internet; (ii) submitting an entry or otherwise participating in any aspect of the Sweepstakes; (iii) the receipt, ownership or use of any prize awarded; (iv) preparing for, participating in, attending, or traveling to and from any prize-related activity; or (v) any typographical or other error in these Official Rules or the announcement of the offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered.

LIMITATION OF LIABILITY:

By entering, you agree to release and hold harmless Brightline Trains Florida, LLC, its parent company, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.

DISPUTES:

Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Miami-Dade County, Florida. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
